 Article 1 – Scope of application

These General Terms and Conditions of Sale (hereinafter referred to as "GTC") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("The Customers" or "The Customer") wishing to purchase the products offered for sale ("The Products") by the Seller on the website www.whitecrowleather.com. The Products offered for sale on the website are as follows:

  • Handmade leather goods
  • Handmade costume jewelry

The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products, are presented on the website www.whitecrowleather.com which the customer is required to read before ordering.

The choice and purchase of a Product is the sole responsibility of the Customer.

Product offers are subject to availability, as specified when placing the order.

These Terms and Conditions are accessible at any time on the website www.whitecrowleather.com and shall prevail over any other document.

The Customer declares that they have read and accepted these Terms and Conditions by ticking the box provided for this purpose before implementing the online ordering procedure on the website www.whitecrowleather.com.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

The Products presented on the website www.whitecrowleather.com are offered for sale in the following territories: Worldwide.

In the case of an order to a country other than metropolitan France, the Customer is the importer of the Product(s) concerned.

For all Products shipped outside the European Union and French overseas territories, the price will be calculated excluding taxes automatically on the invoice.

Customs duties, local taxes, import duties, or state taxes may be applicable. These will be borne by and are the sole responsibility of the Client.

ARTICLE 2 – Prices

The Products are supplied at the prices in effect on the website www.whitecrowleather.com, at the time the order is registered by the Seller.

Prices are expressed in Euros (VAT not applicable, art. 293B of the CGI).

The prices take into account any discounts that may be granted by the Seller on the website www.whitecrowleather.com.

These prices are fixed and non-revisable during their period of validity, but the Seller reserves the right, outside the period of validity, to change the prices at any time.

Prices do not include processing, shipping, transport and delivery fees, which are charged separately, under the conditions indicated on the website and calculated prior to placing the order.

In the case of customized orders, the Seller provides the Customer with a quote clearly indicating the details of the prices, including processing, shipping, transport and delivery fees.

The payment requested from the Customer corresponds to the total amount of the purchase, including these fees.

An invoice is issued by the Seller and given to the Customer upon delivery of the Products ordered.

ARTICLE 3 – Orders

It is the Client's responsibility to select the Products they wish to order on the website www.whitecrowleather.com, according to the following terms:

The Customer selects a Product and adds it to their basket. They can then remove or modify the Product before confirming their order and accepting these terms and conditions of sale. Next, they will enter their contact information or log in to their account and choose the delivery method. After the information is confirmed, the order will be considered final and will require payment from the Customer according to the stipulated terms.

Product offers are valid as long as they are visible on the website, subject to available stock.

The sale will only be considered valid after full payment of the price. It is the Client's responsibility to verify the accuracy of the order and to report any errors immediately.

Any order placed on the website www.whitecrowleather.com constitutes the formation of a distance contract between the Customer and the Seller.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to payment for a previous order.

The Customer will be able to track the progress of their order on the website.

For custom orders, the ordering procedure is as follows:

  • The Seller, for the purposes of order security and fraud prevention, requires the Customer to provide, within 15 days, a copy of their identity document and proof of address dated within the last 3 months.
  • Upon receipt of the requested documents, the Seller sends the Client by email a quote corresponding to their personalization request and indicating the estimated completion times.
  • The Client has one month to return the signed and duly approved quote to the Seller by email.
  • Following acceptance of the aforementioned quote by the Client, the Seller will send the Client a secure payment link (payment by credit card) by email, in accordance with the terms and conditions set out in Article 4 of these General Terms and Conditions.
  • After the Seller receives the sums due from the Client, in accordance with the terms set out in Article 4 of these General Terms and Conditions, the order is deemed final and its production is initiated.
  • Any modification by the Client to the specifications of their order after production has begun may be subject to additional charges by the Seller.
  • The Seller keeps the Customer regularly and reasonably informed of the progress of their order, until it is taken over by the designated carrier according to the terms defined in article 5 of these General Terms and Conditions.

Any cancellation of the order by the Customer after its acceptance by the Seller will only be possible within 14 days at the latest after acceptance of the order by the Seller and as long as delivery has not taken place (regardless of the provisions relating to the application or not of the legal right of withdrawal).

ARTICLE 4 – Payment Terms

The price is paid via secure payment, according to the following terms:

  • payment via bank card,
  • payment via ApplePay,
  • payment via PayPal.

The price is payable in full by the Customer on the day the order is placed.

Payment data is exchanged in encrypted mode using the protocol defined by the approved payment provider involved in banking transactions carried out on the website www.whitecrowleather.com.

Payments made by the Customer will only be considered final after the Seller has effectively received the amounts due.

For custom sizes and/or finishes, the full amount is due at the time the order is placed and payable within 7 days by the Customer, otherwise the order will be automatically cancelled. Payment is made by credit card via a secure online link that the Seller sends to the Customer by email.

For unique creations, a deposit of 30% of the total price is required at the time of order placement and is payable within 7 days by the Client; otherwise, the order will be automatically cancelled. Payment is made by credit card via a secure online link that the Seller sends to the Client by email. The remaining balance is due upon shipment of the order, using the same payment method.

The Seller will not be obliged to deliver the Products ordered by the Customer if the Customer does not pay the full price under the conditions indicated above.

ARTICLE 5 – Deliveries

Delivery consists of transferring physical possession or control of the Product to the Customer. Unless otherwise specified or in the event of unavailability of one or more Products, the Products ordered will be delivered in a single shipment.

The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the aforementioned time limits.

The transfer of risk of loss or damage to the Products will only occur when the Customer takes physical possession of them. Therefore, the Products travel at the Seller's risk, except when the Customer has chosen the carrier. In this case, the risk is transferred upon delivery of the goods to the carrier.

Our shipping provider is Colissimo, which you can find out more about via the following link: https://www.colissimo.entreprise.laposte.fr/colissimo-qui-sommes-nous. Deliveries are made to the address provided by the Customer when placing the order and to which the carrier can easily access.

Processing times

Our indicative processing times are in addition to shipping times. We generally process your orders within 3 days, except in exceptional circumstances that may cause potential delays (high order volume, accidents, etc.) and for personalized orders, for which the processing times are indicated on the quote we send you.

Shipping methods  

Our shipping partner offers the following shipping methods: home delivery without signature, home delivery with signature, delivery to a collection point (network of 52,000 collection points in Europe).

Costs

Shipping costs are calculated automatically at checkout, in addition to the product prices. These prices change annually and depend on both the delivery destination (based on the address provided by the customer) and the total weight of the order. Customs and taxes

All applicable customs duties, taxes, and fees are the responsibility of the buyer. We advise you to check with your local customs authorities regarding any applicable customs fees.

Delivery times

All delivery times below are given as an indication and are expressed in working days.

Deliveries to France

Home delivery with or without signature or secured by code: within 24/48 hours.

Delivery to a collection point: at the Post Office, at a Pickup relay point, at a Pickup locker within 24/48 hours.

Deliveries to French Overseas Territories

Delivery with or without signature of the recipient:

  • From day 5 to zone OM1, excluding Mayotte and St-Pierre-et-Miquelon,
  • From day 7 to the OM2 zone, Mayotte and St-Pierre-et-Miquelon.

International deliveries

Home delivery, with or without signature: from J+3 for Continental Europe and J+5 for the rest of the world to major economic centers.

Order tracking

When your order is shipped, we will provide you with a tracking number by email, it being understood that shipment tracking is provided for purely informational purposes and is free of charge by our shipping provider.

Items damaged or lost during transport

In the event that a package is deemed lost or damaged, you have 14 business days to contact our customer service department:

We will ask you to provide us with any supporting documentation to substantiate the situation (photographs, notes on the delivery slip, etc.). We therefore encourage you to check the condition of the goods in the presence of the carrier upon receipt.

After this period and if these formalities have not been respected, the Products will be deemed compliant and free from any apparent defects and no claim will be validly accepted by the Seller.

We undertake to review your request within 7 working days and to replace the items at our expense or refund them, at the latest by the expiry of this period, except for the exclusions provided for in theArticle L. 221-15 of the Consumer Code.

If you opt for a refund, it will be issued via the same payment method used for the purchase.

Note: Refunds can take up to 3 to 5 business days to appear in your account. This timeframe depends on bank processing times.

Delivery delay exceeding 14 working days after the estimated delivery date

If the ordered products have not been delivered within 14 days of the estimated delivery date, for any reason other than force majeure or the customer's own actions, the sale may be cancelled upon your written request, under the conditions stipulated in the articles L 216-2, L 216-3 and Article L241-4 of the Consumer Code.

We will then refund the amounts paid no later than 14 days following the date of cancellation of the contract, excluding any compensation or deductions. This refund will be made via the same payment method used for the purchase and may take 3 to 5 business days to appear in your account.

ARTICLE 6 – Transfer of Ownership

Ownership of the Products will only transfer from the Seller to the Customer after full payment of the price by the latter, regardless of the delivery date of said Products.

ARTICLE 7 – Right of Withdrawal

According to the terms of Article L221-18 of the Consumer Code, "For contracts providing for the regular delivery of goods over a defined period, the period runs from the receipt of the first good." This withdrawal period is set at 14 days.

Pursuant to Article L221-18 of the Consumer Code, paragraph 3, "the right of withdrawal cannot be exercised for contracts [...] for the supply of goods made to the consumer's specifications or clearly personalized".

No cancellation by the Client of a personalized order after its production has begun will be eligible for a refund of any deposit paid.

The right of withdrawal can be exercised online, using the attached withdrawal form and also available on the website or any other unambiguous statement expressing the wish to withdraw, including by post addressed to the Seller at the postal or email address indicated in ARTICLE 1 of the General Terms and Conditions.

Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.) allowing for their resale as new, accompanied by the purchase invoice.

Damaged, soiled or incomplete products will not be accepted for return.

Return shipping costs are the responsibility of the Seller. To this end, and no later than 3 days after the Seller acknowledges the Customer's withdrawal request, the Seller will send the Customer a shipping label by email, which the Customer must affix to their shipment. Failure to comply with this requirement will preclude the Customer from claiming reimbursement from the Seller for shipping costs exceeding those incurred by the Seller for issuing the shipping label.

The exchange (subject to availability) or refund will be made within 14 days of the Seller's receipt of the Products returned by the Customer under the conditions set out in this article.

ARTICLE 8 – Returns and refunds

The returns processing includes the following steps:

Conditions for returns

From the date of your return or refund request, you have 14 calendar days to return the product(s) in question. Return shipping costs are covered by us, and we will therefore provide you with the shipping label by email to affix to your package.

Items must be in their original condition, unused and free from any damage or wear. They must be accompanied by their complete original packaging, including labels and accessories.

We advise you to carefully pack the items to be returned.

Products not covered by our return policy:

  • Any product modified after delivery cannot be returned.
  • Items showing signs of misuse, damage or wear cannot be returned.
  • Personalized items are not eligible for return, except in the case of a clear manufacturing defect.

ARTICLE 9 – Seller's Liability – Warranties

The Products supplied by the Seller benefit from:

  • of the legal guarantee of conformity, for defective, damaged or faulty Products or Products not corresponding to the order,
  • of the legal guarantee against hidden defects arising from a flaw in materials, design or manufacturing affecting the delivered products and rendering them unfit for use,

Provisions relating to legal guarantees

Article L217-4 of the Consumer Code

"The seller is obligated to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller's responsibility under the contract or was carried out under the seller's supervision."

Article L217-5 of the Consumer Code

"The property conforms to the contract:"

1° If it is suitable for the purpose usually expected of similar goods and, where applicable:

– if it corresponds to the description given by the seller and possesses the qualities that the latter presented to the buyer in the form of a sample or model;

– if it possesses the qualities that a buyer can legitimately expect, having regard to the public statements made by the seller, the producer or their representative, particularly in advertising or labelling;

2° Or if it possesses the characteristics defined by mutual agreement between the parties or is suitable for any special purpose sought by the buyer, which has been brought to the seller's attention and accepted by the latter.

Article L217-12 of the Consumer Code

"The action resulting from a lack of conformity is time-barred two years from the date of delivery of the goods."

Article 1641 of the Civil Code.

"The seller is bound by a warranty against hidden defects in the thing sold which render it unfit for its intended use, or which diminish that use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them."

Article 1648, paragraph 1 of the Civil Code

"The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect."

Article L217-16 of the Consumer Code.

“When the buyer requests the seller, during the term of the commercial warranty granted to them upon the purchase or repair of movable property, to carry out repairs covered by the warranty, any period of immobilization of at least seven days is added to the remaining term of the warranty. This period begins from the date of the buyer's request for intervention or the date the property in question is made available for repair, if this latter date is later than the request for intervention.”

In order to assert his rights, the Customer must inform the Seller, in writing (email or letter), of the non-conformity of the Products or of the existence of hidden defects from the date of their discovery.

The Seller will refund, replace or repair Products or parts under warranty deemed non-compliant or defective.

Shipping costs will be refunded based on the invoiced rate and return costs will be refunded upon presentation of proof of payment.

Refunds, replacements, or repairs of Products deemed non-compliant or defective will be carried out as quickly as possible and no later than 14 days following the Seller's confirmation of the non-compliance or hidden defect. This refund may be issued by bank transfer or bank check.

The Seller shall not be held liable in the following cases:

  • non-compliance with the legislation of the country in which the products are delivered, which it is the Client's responsibility to verify,
  • in case of misuse, use for professional purposes, negligence or lack of maintenance by the Customer, as well as in case of normal wear and tear of the Product, accident or force majeure.

La garantie du Vendeur est, en tout état de cause, limitée au remplacement ou au remboursement des Produits non conformes ou affectés d’un vice avéré. Les Produits proposés étant réalisés à la main, de manière artisanale, il est normal que ceux-ci présentent de légères variations.

In accordance with the Intellectual Property Code and the provisions relating to the protection of copyright, any total or partial reproduction of this content is strictly prohibited and may constitute an infringement offense.

The names, titles, designs and content are protected.

ARTICLE 12 – Applicable Law – Language

These Terms and Conditions and the transactions arising therefrom are governed by and subject to French law.

These Terms and Conditions are originally written in French. If they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.

ARTICLE 13 – Disputes

For any complaints, please contact customer service at the Seller's postal or email address indicated in ARTICLE 1 of these Terms and Conditions.

The Client is informed that in any event, he may resort to conventional mediation, with existing sectoral mediation bodies or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.
